Mr. SENBENBRENNER (for himself and Mr. HYDE) submitted the following resolution; which was referred to the Committee on the Judiciary

RESOLUTION

Impeaching Alcee L. Hastings, judge of the United States District Court for the Southern District of Florida, of high crimes and misdemeanors.

TO THE SPEAKER, UNITED STATES HOUSE OF REPRESENTATIVES:

The Judicial Conference of the United States, acting pursuant to section 331 of title 28, United States Code, does hereby certify as follows:

1. On September 2, 1986, the Judicial Council of the Eleventh Circuit eertified to the Judicial Conference, as provided by 28 D.B.C. $372(e)(7) (B), that United States District Judge Aleee L. Hastings of the Southern District of Florida has engaged in conduet which might eonstitute grounds for impeachment under Article 1 of the United States Constitution.

2. The Judicial Conference has exercised its authority under 28 U.B.C. $372(e)(8) to consider the certificate of the Judicial Council of the Eleventh Cireuft. In so doing, the Judicial Conference had before it the certificate of the Judicial Council of the Eleventh Circuit, filed pursuant to 28 U.S.C. $372 (e) (7) (B), the Report of the Investigating Committee appointed by the Chief Judge of the Eleventh Circuit pursuant to 28 U.S.C. 6372(e)(4)(A), the record and exhibits compiled by that Committee, and a Statement and Provisional and Preliminary Report prepared by counsel for Judge Hastings and filed with the Judicial Conference in response to the invitation set forth in a Resolution adopted by the Conference on September 17, 1986.

The Judicial Conference considers no additional

investigation by it to be appropriate.

4. The Judicial Conference concurs in the determination of the Judicial Council of the Eleventh Cireult that consideration of impeachment may be warranted.

Material received by the Subcommittee in executive session,
and material made confidential by 28 U.S.C. 372 that is in
the possession of the Subcommittee, shall be kept in secure
places under the control of the Subcommittee.

Only Members of Congress and staff of the Committee on the
Judiciary designated by the Chairman of the Committee on the
Judiciary, in consultation with the Ranking Minority Member
of the Committee, may have access to such material.

A Member of Congress who wants to review such material shall arrange to do so by contacting Committee General Counsel M. Elaine Mielke at 58088.

A Member of Congress who wants to review such material shall first acknowledge having read this document and agree to abide by the procedures set forth herein.

The Subcommittee shall make such material available to Members of Congress in a reading room under the following conditions:

(a) Such material shall be available during regular Subcommittee hours.

(b) Such material shall not be removed from the reading room.

A staff member shall be present at all times.
No notes, reproductions, or recordings shall be
made of any such material.

Staff shall keep a log of all Members of Congress
who review such material.

Subcommittee staff shall ensure that such material reviewed by a Member of Congress is returned to the files.

The contents of executive session material shall not be disclosed to any unauthorized person in any manner until such disclosure is authorized under the Rules of the Bouse of Representatives.

The contents of any material made confidential by 28 0.5.c. 372 shall not be disclosed to any unauthorized person in any Banner until such disclosure is authorized under 28 U.S.c. 372.
