The capital of the fund shall consist of any 3 appropriations made for the purpose of providing capital 4 (which appropriations are hereby authorized) and the fair 5 and reasonable value of such stocks of supplies, equipment, 6 and other assets and inventories on order as the Secretary 7 may transfer to the fund, less the related liabilities and un8 paid obligations. Such fund shall be reimbursed in advance 9 from available funds of agencies and offices in the Depart10 ment, or from other sources, for supplies and services at rates 11 which will approximate the expense of operation, including 12 the accrual of annual leave and the depreciation of equip13 ment. The fund shall also be credited with receipts from sale 14 or exchange of property and receipts in payment for loss or 15 damage to property owned by the fund. There shall be 16 covered into the United States Treasury as miscellaneous 17 receipts any surplus found in the fund (all assets, liabilities, 18 and prior losses considered) above the amounts transferred 19 or appropriated to establish and maintain such fund.

(h) The Secretary may approve a seal of office for the 21 Department, and judicial notice shall be taken for such seal. 22 (i) In addition to the authority contained in any other 23 Act which is transferred to and vested in the Secretary, as 24 necessary, and when not otherwise available, the Secretary 25 is authorized to provide for, construct, or maintain the fol

(4) Motion picture equipment and film for rec

reation and training; and

(5) Living and working quarters and facilities.

The furnishing of medical treatment under paragraph (1)

and the furnishing of services and supplies under paragraphs

11 (2) and (3) of this subsection shall be at prices reflecting reasonable value as determined by the Secretary, and the 13 proceeds therefrom shall be credited to the appropriation 14 from which the expenditure was made.

(j) The Secretary is authorized to accept, hold, ad16 minister, and utilize gifts and bequests of property, both 17 real and personal, for the purpose of aiding or facilitating 18 the work of the Department.

19 (k) The Secretary is authorized to appoint, without 20 regard to the provisions of title 5, United States Code, relat21 ing to appointments in the competitive service, such advisory 22 committees as may be appropriate for the purpose of con23 sultation with and advice to the Department in performance 24 of its functions. Members of such committees, other than

those regularly employed by the Federal Government, while 2 attending meetings of such committees or otherwise serving

3 at the request of the Secretary, may be paid compensation 4 at rates not exceeding those authorized for individuals under

5

subsection (b) of this section, and while so serving away

from their homes or regular places of business, may be 7 allowed travel expenses, including per diem in lieu of sub

8 sistence, as authorized by section 5703 of title 5, United

9

States Code, for persons in the Government service em10 ployed intermittently.

(1) (1) The Secretary is authorized to enter into contracts with educational institutions, public or private agencies

or organizations, or individuals for the conduct of research 14 into any aspect of the problems related to the programs of

15 the Department which are authorized by statute.

16

(2) The Secretary may from time to time disseminate 17 in the form of reports or publications to public or private 18 agencies or organizations, or individuals such information as 19 he deems pertinent on the research carried out pursuant to 20 this subsection.

(3) Nothing contained in this subsection is intended

22 to amend, modify, or repeal any provision of law adminis23 tered by the Department which authorizes the making of 24 contracts for research.

ANNUAL REPORT

SEC. 105. The Secretary shall, as soon as practicable

3 after the end of each fiscal year, make a report in writing to 4 the President for submission to the Congress on the activities

5 of the Department during the preceding fiscal year.

SAVINGS PROVISIONS

SEC. 106. (a) All orders, determinations, rules, regula

8 tions, permits, contracts, certificates, licenses, and privileges—

(1) which have been issued, made, granted, or allowed to become effective in the exercise of any func

tion transferred by this part, and

(2) which are in effect at the time this part takes effect,

14 shall continue in effect according to their terms until modi15 fied, terminated, superseded, set aside, or repealed by the 16 Secretary, by any court of competent jurisdiction, or by 17 operation of law.

(b) This part shall not affect any proceedings pending at the time this section takes effect before any officer, any 20 function of whom is transferred by this part; but such pro21 ceedings, to the extent that they relate to functions so trans22 ferred, shall be continued before the Department. Such 23 proceedings, to the extent they do not relate to functions so 24 transferred, shall be continued before the officer before whom 25 they were pending at the time of such transfer. In either case

1 orders shall be issued in such proceedings, appeals shall be 2 taken therefrom, and payments shall be made pursuant to 3 such orders, as if this part had not been enacted; and orders 4 issued in any such proceedings shall continue in effect until 5 modified, terminated, superseded, or repealed by the Secre6 tary, by a court of competent jurisdiction, or by operation 7 of law.

(c) (1) Except as provided in paragraph (2)—
(A) the provisions of this part shall not affect suits
commenced prior to the date this section takes effect, and
(B) in all such suits proceedings shall be had,
appeals taken, and judgments rendered, in the same

manner and effect as if this part had not been enacted.

14 No suit, action, or other proceeding commenced by or 15 against any officer in his official capacity shall abate by

16

reason of the enactment of this part. Causes of action, suits, 17 actions, or other proceedings may be asserted by or against 18 the United States or such official of the Department as may 19 be appropriate and, in any litigation pending when this 20 - section takes effect, the court may at any time, on its own 21 motion or that of any party, enter an order which will give 22 effect to the provisions of this subsection.

(2) If before the date on which this part takes effect 24 any officer in his official capacity is a party to a suit, and 25 under this part any function of such officer is transferred to
